37. Regarding counting of the period of induction training for benefit of promotion under the TBOP/BCR Schemes :- The issue regarding counting of the period of induction training spent by the employees of this Department for the benefit of promotion under the TBOP/BCR schemes has been under consideration of this office for some time. After consultation with the Department of Personnel and Training, it has now been decided that the period of induction training may also be counted for the benefit of promotion under the above schemes. However, past cases decided otherwise would not be covered by the above orders. This issue with the concurrence of Integrated Finance Advice vide their Diary No. 378/FA/2000 dated 25.7.2000.

38. Counting of the period of induction training for benefit of promotion under the TBOP/BCR schemes-clarifications:-(1) I am directed to refer to this Department's letter of even number dated 3.8.2000 [Para 37] on the above subject. References have been received from many Circles seeking clarifications on the above orders. The matter has been examined in detail in consultation with the Integrated Finance Wing of this Department and the position is clarified as under.

(2) This issues with the concurrence of Integrated Finance Wing vide their Diary No. 320/FA/2001 dated 17.7.2001.
               Points raised
Clarification
(1) What will be the date of effect of the above order,
The cases decided prior to 3.8.2000 would not be covered by the order dated 3.8.2000.

(2) Whether the departmental candidates will also get the benefit of counting of induction training period prior to their promotion as Time scale clerks for the  benefit of promotion under  benefit of promotion under  TBOP/BCR ?                                                                                           
DO P&T has clarified that since the period of induction training is counted for the purpose of increments and qualifying       service for departmental examination, it would also count for the purpose of promotion under the TBOP/BCR schemes.
Therefore, it is clarified that the period of induction training in respect of departmental candidates would also count for the purpose of promotions under TBOP/BCR schemes provided that such training period is obligatory for the departmental candidates in respect of the cadre to which they are to be promoted and they are to be promoted immediately on completion of such induction training period and also such         training period is counted for increment in the promoted cadre.
(3) If the junior officials get               promoted earlier than the   seniors as per the orders   dated 3.8.2000, whether the   seniors can claim benefit of       promotion under the above scheme from the date of promotion of the junior officials? 
                                                      
As per letter No. 22-6/2000-PE.I dated 17.5.2000, officials would be promoted under the TBOP/BCR schemes only after completion of qualifying service. Therefore, the question of senior claiming benefit with reference to the juniors etc. does not arise.

New Rashtrapati Bhavan museum complex to open for public from October 2, 2016


The New Rashtrapati Bhavan Museum Complex which now includes the Garages Museum and Clock Tower in addition to the Stables Museum will open for the public from October 2, 2016.


The Museum Complex will be open all days from 0900 hrs. to 1600 hrs. except Mondays. Entry and exit for visitors will be through Gate No. 30 on Mother Teresa Crescent Road.

Visits can be booked on-line at the website www.presidentofindia.nic.in. There will be nominal registration charges of Rs. 50/- per head (Children below the age of 8 years will be exempt from charges).

GDS BONUS CEILING ENHANCEMENT CASE



Com. R. N. Parashar, Secretary General and Com. Giriraj Singh, President NFPE met Member (P) Postal services Board on 23.09.2016 and discussed the GDS bonus ceiling enhancement case. Member (P) informed that as GDS Committee is functioning it is decided that the case is to be referred to GDS Committee for favourable recommendation. Accordingly the file has been sent to Chairman, GDS Committee.

Com. R. N. Parashar, Secretary General, NFPE discussed the case with Shri. Kamlesh Chandra, Chairman, GDs Committee. Chairman assured that Committee will examine the case and give its recommendation without any delay. As Nataraja Murthy Committee has made adverse recommendations, Shri Kamlesh Chandra has told that he has to study the whole case before taking a decision. The issue will be again discussed with Chairman, GDS Committee when Secretary General, NFPE and Com. Panduranga Rao, General Secretary, AIPEU-GDS are meeting the Chairman in the first week of October 2016.

After getting recommendation of the GDS committee, the file is to be sent to Finance Ministry for approval.

DA from July 2016 in 7th pay Commission is 2% or 3% is yet to be confirmed

It seems that the DA from July 2016 in 7th Pay Commission is not yet finalized by Central Government. There is confusion persists on the rate of Dearness Allowance to be paid from 1st July 2016 in revised Pay . The AICPIN average for the year 2015 to be taken as Base Index for calculation of DA in 7th CPC as the DA has been neutralized to arrive the revised Pay.

The actual AICPIN Average for 2015 is 261.33. As per this AICPIN average, the DA to be paid at the rate of 2% from July 2016 in 7th CPC . But the NCJCM has contended that it should be paid at the rate of 3%.

The NCJCM staff side said that as per the practice of fraction is being ignored, 0.75 is ignored from actual DA 125.75 as on 1st January 2016. Since the 125% DA was merged to revise the 7th CPC pay, Accordingly, the AICPIN average of 2015 has to be revised to 260.46 from 261.33 to arrive the exact rate of DA of 125% .

It is obvious that the NCJCM Staff Sides claim has sufficient merits to be considered favorably by the Government. In that case, the DA to be paid from July 2016 will be 3%.

The NCJCM Staff Side should be appreciated for this timely intervention and effort.

The central Government need to take decision in this regard soon, as it has been passed third week of September. Usually the announcement of DA for July every year will be made in the first or second week of September.

MEDICAL TREATMENT IN EMERGENT CIRCUMSTANCES

Question: TREATMENT IN EMERGENCY 
The following ailments may be treated as emergency which is illustrative only and not exhaustive, depending on the condition of the patient:
                                              Acute Coronary Syndromes (Coronary Artery Bye­pass Graft / Percutaneous, Transluminal Coronary Angioplasty) including Myocardial Infarction, Unstable Angina, Ventricular Arrhythmias, Paroxysmal Supra Ventricular Tachycardia, Cardiac Temponade, Acute Left Ventricular Failure I Severe Congestive Cardiac Failure, Accelerated Hypertension, Complete Heart Block and Stoke Adam attack, Acute Aortic Dissection. Acute Limb Ischemia, Rupture of Aneurysm, Medical and Surgical shock and peripheral circulatory failure Cerebro­Vascular attack­Stokes, Sudden unconsciousness, Head injury, Respiratory failure, decompensated lung disease, Cerebro­Meningeal infections, Convulsions, Acute Paralysis, Acute Visual loss, Acute Abdomen pain, Electric Shock Road Traffic Accidents 1 with injuries including fall. Severe Hemorrhage due to any cause, Acute poisoning, Acute Renal Failure. Acute abdomen pain in female including acute Obstetrical and Gynecological emergencies Any other life threatening condition.

 Reply:­                               In emergency the hospital will not refuse admission or demand an advance payment from the beneficiary or his family member and will provide credit facilities to the patient whether the patient is a serving employee or a pensioner availing CGHS facilities, on production of a valid CGHS card and the hospital shall submit the bill for reimbursement to the concerned Deptt./Ministry/CGHS. The refusal to provide the treatment to bonafide CGHS Beneficiaries in emergency cases and other eligible categories of beneficiaries on credit basis, without valid ground, would attract disqualification for continuation of empanelment.

                                          The nature and appropriateness of the emergency is subject to verification, which may be verified, inspected or medically audited by the nominated authority on random basis at its own discretion. The Hospital will intimate all instances of patients admitted as emergencies without prior permission to the CGHS authorities / BCA appointed by CGHS within the prescribed time.

NFPE persuation on Bonus to GDS

Today on dated 16-09.2016, Com. R.N. Parashar, Secretary General NFPE met DDG (Estt) Shri S.K. Dashora and enquired about the progress of enhancement of Bonus Ceiling of GDS.

 

           Shri Dashora intimated that the matter is in process. File has been sent to JS&FA and after approval from him will be sent to Finance Ministry for sanction.

 

           NFPE is trying its best to get the ceiling of Bonus raised for GDS as early as possible

Subject:- Central Civil Services (Leave Travel Concession) Rules, 1988 – Relaxation to travel by air to visit NER, J&K and A&N.

The undersigned is directed to refer to this Department’s O.M. of even No. dated 26.09.2014 on the subject noted above and to say that relaxation of CCS (LTC) Rules, 1988, to allow Government servants to travel by air to North East Region (NER), Jammu and Kashmir (J&K) and Andaman & Nicobar Islands (A&N) is extended for a further period of two years w.e.f. 26th September, 2016 subject to the following conditions:

(a) Travel by air to continue to be performed by Air India in Economy class at LTC-80 fare or less.

(b) For journey by air to Jammu & Kashmir, travel by any airline is allowed, however, the journey should be undertaken in Economy class at a fare less than or equal to LTC-80 fare of Air India.

(c) The condition that air tickets can be purchased either directly from the airlines (booking counters/website) or through authorized agents only viz., ‘M/s Balmer Lawrie and Co.Ltd.’, ‘M/s Ashok Travels and Tours Ltd.’ and ‘IRCTC’ (to the extent IRCTC is authorized as per DoPTs O.M. No. 31011/6/2002-Estt.(A) dated 02.12.2009), shall necessarily apply.

(d) Efforts should be made by the Government servants to book the air tickets at the cheapest fare possible. All the Ministries/Departments are advised to bring it to the notice of all their employees that any misuse of LTC will be viewed seriously and the employees will be liable for appropriate action under the rules. In order to keep a check on any kind of misuse of LTC, Ministries/Departments verified from the Airlines concerned with regard to the actual cost of air travel vis-a-vis the cost indicated on the air tickets submitted by the officials.

2. All other conditions prescribed in this Department’s O.M. of even No. dated 26.09.2014 shall continue to apply.

3. In their application to the staff serving in the Indian Audit and Accounts Department, this order issue after consultation with the Comptroller and Auditor General of India.

After GST, focus is on labour reforms

NEW DELHI: The government is gearing up for bold labour reforms after putting the goods and services tax (GST) back on track. An inter-ministerial group on labour headed by finance minister Arun Jaitley is slated to meet on September 15 to reconsider the labour ministry's proposal to introduce two legislations aimed at significantly enhancing ease of doing business in the country.


"The inter-ministerial group will meet to consider afresh the Wage Code Bill and the Small Factory Bill a senior labour ministry official told ET on condition of anonymity. The high-level group had met in December last year to discuss the two legislations.

Although everybody was on board regarding the content of the legislations, the group decided to put them on hold till the passage of GST Bill, the single most crucial taxation reform being pushed by the government at the time. "The group was of the view that let us not create any straw of resistance until the GST goes through. Now the road ahead seems to be clear for the government to push for more big-ticket legislation," the official said.


The labour code on wages provides for a minimum floor level national wage which will be mandatory for all states. This will give a boost to the government's recent initiative of increasing minimum wages 42%, a provision that currently applies only to central government employees and is only an advisory for states.


Besides, the labour ministry plans to streamline the definition of wages by amalgamating four wage-related statutes.

These include the Minimum Wages Act, 1948; the Payment of Wages Act, 1936; the Payment of Bonus Act, 1965; and the Equal Remuneration Act, 1976 to simplify the process of operating business in India. At present, there are about half a dozen definitions of wages in various acts across Centre and states which employers have to grapple with.

The Small Factories (Regulation of Employment and Conditions of Services) Bill, 2014 intends to make life simpler for small and medium enterprises, which are expected to flourish under the improved ease of doing business regime and in turn create employment.

The bill, pending for two years, aims to bring all small factories under a common regulation and exempt them from 14 central labour laws. It envisages rules for wages, overtime hours as well as social security.

            The Government of India, Ministry of Finance issued order on revised ceiling limit of PLB from Rs.3500- to Rs.7000- from the year 2014-15 (OM No. 7/4/2014-E-III A dated 29-08-2016) to all Central Govt. Employees. It is apparent to note that the calculation of  Productivity Linked Bonus  for the year 2014-15 with revised ceiling limit @ Rs.7000-to regular departmental employees in the Department of Posts  has been granted vide letter No. .26-01/2015-PAP dated  02-09-2016 and the arrears have also been drawn in favour of the regular employees.

            The case of 3 lakh GDS employees regarding applicability of revised ceiling limit @Rs.7000- is yet to be finalized by the Department.

            Therefore, it is requested to kindly expedite the grant of Bonus to 3 lakh Gramin Dak Sevaks at the revised ceiling @ Rs.7000- from 2014-15 prospectively.

            Early action is highly solicited.
