ఇది ఉద్యోగుల హక్కు.. కాంట్రాక్టు పేరిట తక్కువ జీతం తప్పుశ్రమ దోపిడీకి కృత్రిమ ప్రాతిపదికలు చెల్లవు.. సుప్రీం సంచలన తీర్పు


'కాంట్రాక్టు ఉద్యోగులకూ శాశ్వత ఉద్యోగులతో సమానంగా వేతనాలు చెల్లించాల్సిందే' అని సుప్రీంకోర్టు స్పష్టం చేసింది. ప్రభుత్వ, ప్రభుత్వరంగ సంస్థల్లో కాంట్రాక్టు పద్ధతిలో పని చేస్తున్న లక్షలాది మంది ఉద్యోగులు, కార్మికులకు ఊరటనిచ్చేలా ఆదేశాలు జారీ చేసింది. 'ఒకే పనికి... ఒకే రకమైన వేతనం' అన్న విధానాన్ని అనుసరించాల్సిందే అని స్పష్టం చేసింది. జస్టిస్‌ జేఎస్‌ ఖేహర్‌, జస్టిస్‌ ఎస్‌ఏ బాబ్డేలతో కూడిన ధర్మాసనం బుధవారం ఈ ఆదేశాలు జారీచేసింది.

పంజాబ్‌ రాష్ట్రానికి చెందిన ఒక కాంట్రాక్టు ఉద్యోగి దాఖలు చేసిన కేసులో సుప్రీంకోర్టు ఈ తీర్పు చెప్పింది. రెగ్యులర్‌ ఉద్యోగులతో సమానంగా తనకు వేతనం చెల్లించాలని ఆయన కోరారు. అయితే... కాంట్రాక్టు ఉద్యోగులకు పర్మినెంట్‌ ఉద్యోగుల్లా వేతనాలు వర్తించవని పంజాబ్‌, హరియాణా ఉమ్మడి హైకోర్టు తీర్పు చెప్పింది.

ఈ తీర్పును సుప్రీంకోర్టు ఇప్పుడు పక్కన పెట్టింది. ''ఒక రకమైన పని చేస్తున్న వారందరికీ ఒకే విధమైన వేతనం అందాలి. కార్మికులకు వారి ప్రయోజనాలు అందకుండా చేసేందుకు కృత్రిమ ప్రాతిపదికలు సృష్టించడం తప్పు. ఒకవిధమైన బాధ్యతలు నిర్వర్తిస్తూ, ఒకే రకమైన పని చేస్తున్న వ్యక్తికి (కాంట్రాక్టు పేరిట)...
మరొకరికంటే (పర్మినెంట్‌) తక్కువ జీతం ఇవ్వడం కుదరదు. మరీ ముఖ్యంగా సంక్షేమ రాజ్యంలో అస్సలు కుదరదు'' అని ధర్మాసనం పేర్కొంది. ''ఎవ్వరూ తమ ఇష్టం ప్రకారం తక్కువ వేతనం తీసుకుని పని చేయడు. తమ కుటుంబాన్ని పోషించుకునేందుకు...
తప్పని సరి పరిస్థితుల్లో తన ఆత్మగౌరవాన్ని, హుందాను, స్వీయ విలువను తగ్గించుకుని మరీ తక్కువ జీతానికి పని చేస్తారు. అలా చేయకపోతే తమపై ఆధారపడిన వారికి ఇబ్బందులు తలెత్తుతాయని తెలుసు'' అని తీర్పు రాసిన జస్టిస్‌ ఖేహర్‌ పేర్కొన్నారు. ''ఒకే రకమైన పరిస్థితుల్లో, ఒకేరకమైన పని చేసే వారి మధ్య వేతనాల్లో తేడా ఉండటమంటే... శ్రమను దోచుకోవడమే.
ఇది కచ్చితంగా అణచివేత చర్యే'' అని స్పష్టం చేశారు. 'అంతర్జాతీయ ఆర్థిక, సామాజిక, సాంస్కృతిక హక్కుల ఒప్పందంపై భారత 1979 ఏప్రిల్‌ 10వ తేదీన సంతకం చేసింది. దీని ప్రకారం సమాన పనికి సమాన వేతనం పొందే హక్కు లభించింది. దీనిని నుంచి ప్రభుత్వం తప్పించుకోజాలదు.
అంతేఆదు... భారత రాజ్యాంగంలోని ఆర్టికల్‌ 141 ప్రకారం సుప్రీంకోర్టు చెప్పిన తీర్పు ప్రకారం కూడా సమాన పనికి సమాన వేతనం పొందడమనేది తిరుగులేని హక్కు. ఉద్యోగి పర్మినెంటా, కాంట్రాక్టా అనే అంశంతో నిమిత్తం లేదు'' అని ధర్మాసనం తేల్చి చెప్పిం

DA Announced 2 per cent for central government employees, pensioners,w.e.f 01/07/2016



Dearness Allowance hiked by 2 per cent for central government employees, pensioners:


Dearness allowance is provided to employees and pensioners to minimise the impact of price rise on their earnings.

The Cabinet on Thursday approved 2 per cent hike in Dearness Allowance (DA) for central government employees and pensioners, effective from July 1, 2016. The proposal to hike the DA was approved during the Cabinet meeting today afternoon at the Prime Minister’s Office. The announcement, which comes ahead of Diwali, is set to bring cheer to around 50 lakh central government employees and 58 lakh pensioners in the country.

Dearness allowance is provided to employees and pensioners to minimise the impact of price rise on their earnings. Earlier this year, the government hiked dearness allowance by 6% to 125 % of the basic pay. It was later merged into the basic pay, based on the recommendation of the 7th Pay Commission Panel.

REVISION OF MINIMUM PAY AND FITMENT FORMULA
2ND MEETING OF THE GROUP OF SENIOR OFFICERS WITH JCM (NC) STAFF SIDE

DISAPPOINTING

2nd Meetings of the Group of Senior Officers (Constituted as per the assurance given by Group of Minister to NJCA) to discuss the grievances arising out of recommendations related to 7th Central Pay Commission, was held with JCM (NC) staff side on 24.10.2016 at 4 PM. The staff side explained in detail the justification for modification in the minimum pay and fitment formula, which was already explained in the memorandum submitted to Cabinet Secretary on 10th December 2015 and also in the presentation made before Joint Secretary Implementation Cell and Empowered Committee of Secretaries headed by Cabinet Secretary.

From the response of the Senior Officers, it is not clear whether they are mandated to submit a proposal on increasing the Minimum Pay and Fitment formula to Government, as assured by the Group of Ministers on 30th June 2016. Eventhough, the time frame of four months is almost over, the urgency and seriousness was lacking on the part of the Group of officers. It seems that that Government is adopting a delaying tactics or to deny the assured increase. Perhaps, they may recommend an increase in minimum pay and fitment formula at a later date, but it is quite uncertain.

Confederation National Secretariat after reviewing these developments has decided to intensify the campaign and agitational programmes demanding the Government to honour its assurance given to NJCA leadership and also to settle the 20 point charter of demands. Make the 7th November 2016 mass dharna programme a grand success. Ensure maximum participation of employees in the 15th December 2016 massive Parliament March. Get ready for strike.

ALLOWANCE COMMITTEE MEETING ON DOP&T SPECIFIC ALLOWANCES
Meeting of the Allowance Committee to discuss the DOP&T Specific allowances was held on 25.10.2016. Secretary, Department of Personnel Chaired the meeting. Important allowances like Children Education Allowance, Night Duty Allowance, Overtime Allowance, Cash Handling Allowance, Dress Allowance, Nursing Allowance, Patient Care Allowance, Family planning Allowance, Risk Allowance etc. are discussed. The Secretary, Department of Personnel gave a patient hearing and interacted with staff side on certain points. No commitment on any allowance was given.

JCM NATIONAL COUNCIL – STANDING COMMITTEE MEETING
The JCM (NC) Standing Committee meeting under the Chairmanship of Secretary, Department of Personnel was held on 25.10.2016. All agenda items were discussed. Some of the items are – JCM functioning, Compassionate appointments, amendment to the definition of anomaly, Changing MACP conditions, Ex-Servicemen pay fixation, Pay fixation option on promotion after the date of notification of CCS (RP) Rules 2016, GDS bonus enhancement to 7000/-, casual labour regularization and bonus enhancement, filling up of vacancies, upgradation of LDCs to UDCs, one time relaxation of LTC-80 availed by air by purchasing tickets from other than authorized agents, Restoration of Festival Advance, Natural Calamity Advance and Advance of leave salary, grant of entry pay recommended by 6th CPC to the promotes, reimbursement of actual medical expenditure incurred by the employees in a recognised hospital etc.

Secretary, Department of Personnel gave a patient hearing and clarified certain points. No final decision was taken on any of the agenda items. Gist published below. Minutes will be published later. It was informed that based on the discussion, each item will be examined further and decision will be taken.

AUTONOMOUS BODIES – EXTENSION OF 7TH CPC REVISED PAY STRUCTURE AND PENSIONARY BENEFITS
The issue was raised in the JCM Standing Committee meeting held on 25.10.2016 by the staff side. The official side informed that an overall review regarding the performance and financial viability etc. of each Autonomous body is being carried out by the Government. Only after completing the process decision regarding extension of 7th CPC revised pay structure and pensionary benefits, Bonus etc. will be taken. Extension of the benefits depends upon the policy decision of the Government. Hence the official side has not told any time frame for final decision. It is likely to be delayed.

Confederation has already included the demands of the employees of the autonomous bodies in its 20 point charter of demands. All Unions/Associations/Federation and employees of all autonomous bodies are requested to understand the gravity of the situation and make the 7th November 2016 mass dharna programme and 15th December 2016 Parliament March a grand success. Join the Parliament March with your flags, banners and placard with demands. Let the Government understand the discontentment and protest of employees and pensioners of Autonomous bodies. There is no short-cut to get our justified demand accepted by the Government.

GDS BONUS ENHANCEMENT TO 7000
This issue was discussed in the JCM Standing Committee meeting as a notified agenda. The official side informed that the file is still under process in the Finance Ministry and a decision is yet to be taken. Once the approval of the Finance Ministry is given the proposal is to be submitted to Cabinet for approval.

All affiliates and C-O-Cs are once again requested to extend full support and solidarity to the proposed Postal Strike on 9th & 10th November 2016, demanding bonus calculation ceiling limit enhancement to 7000/- for GDS and immediate payment of revised wages to casual labourers from 01.01.2006. Conduct solidarity demonstration in front of important Postal/RMS office on 9th & 10th November 2016.


GIST OF THE JCM STANDING COMMITTEE MEETING HELD ON 25.11.2016

Meeting was held under the chairmanship of Secretary, Department of Personnel. Items discussed and outcome is given below.

1.        JCM FUNCTIONING

Decision: After discussion Secretary (P), assured that the JCM would be activated and steps may be taken to hold regular meetings of JCM at National and Departmental level.

2.        COMPASSIONATE APPOINTMENT:

Decision: The demand of the staff side to remove 5% ceiling would be considered after studying the various. Supreme Court Judgments and the decisions of previous National Council JCM meetings.

3.        RESTORATION OF INTEREST FREE ADVANCES WITHDRAWN BY THE GOVERNMENT BASED ON 7TH CPC RECOMMENDATIONS

DecisionThe demand of the staff side to restore Festival advance, Natural Calamity advance and leave salary advance will be examined further.

4.        AMENDMENT TO THE DEFINITION OF THE TERM “ANOMALY”

Decision: The proposal given by the staff side would be considered is consultation with Department of Expenditure.

5.        FIXATION OF PAY OF RE-EMPLOYED EX-SERVICEMEN

Decision: - The anomalies in the fixation of pay of re-employed Ex-Servicemen is under consideration of DOP&T.

6.  OPTION FOR THOSE TO BE PROMOTED AFTER 25.07.2016, I.E. AFTER THE NOTIFICATION OF CS (REVISED PAY) RULES 2016.

Decision: - This issue would be considered by the Implementation Cell of 7th CPC.

7.        WITHDRAWL OF NEW CONDITIONS FOR THE GRANT OF MACP & GRANT OF MACP ON PROMOTIONAL HIERARCHY

Decision: The demand of the Staff Side for withdrawal of “Very Good” grading would be re-examined. Regarding justification of MACP on Promotional hierarchy all the points submitted alongwith the Note on agenda items by staff side was discussed in detail. The official side agreed to examine issue further based on the points raised by the staff side.

8.       BONUS CEILING TO BE RAISED TO 7000 FOR GRAMIN DAK SEVAK EMPLOYEES OF POSTAL DEPARTMENT

Decision: - Revision of Bonus ceiling for GDS and Casual Labourers would be considered by Department of Expenditure.

9.        REGULARISATION OF CASUAL LABOURERS

Decision: The proposal of the staff side for regularization of all casual labourers would be considered after considering various Supreme Court judgements.

10.     FILLING UP OF EXISTING VACANT POSTS
Decision:  – Since there is no ban on recruitment, vacancies can be filled up. Instructions in this regard will be issued once again.

11.     UPGRADATION OF THE POSTS OF LOWER DIVISION CLERKS TO UPPER DIVISION CLERKS

Decision: The demand of the staff side would be considered in consultation with other Ministries.

12.   GRANT OF ONE TIME RELAXATION TO THE CENTRAL GOVERNMENT EMPLOYEES WHO HAVE AVAILED LTC-80 AND TRAVELLED BY AIR BY PURCHASING TICKETS FROM OTHER THAN AUTHORIZED AGENCIES

Decision: - The proposal of Ministry of Defence in this regard is under examination of DOP&T

13.     GRANT OF ENTRY PAY RECOMMENDED BY 6TH CPC TO THE PROMOTEES UNDER THE PROVISION OF CCS (RP) RULES 2008.

Decision: -    The Judgment of Chennai CAT and Principal Bench New Delhi would be examined by DOP&T and Department of Expenditure.

14. REIMBURSEMENT OF ACTUAL MEDICAL EXPENDITURE INCURRED BY THE EMPLOYEES IN A RECOGNIZED HOSPITAL.

Decision: -    A separate meeting would be held by the Health Ministry with the staff side to discuss this demand.

DA DUE FROM 01-07-2016




In the JCM Standing Committee Meeting, the Staff Side expressed their concern that DA due from 01.07.2016 is not yet announced by the Government. We requested to JS (Pers) DOE to consider the representation of the Staff Side with regard to the calculation of DA percentage. According to the DA index Central Government Employees are eligible for 3% DA and not 2 percent. The JS (Per) informed that the representation of the Staff Side is under consideration and Government would take a decision very soon.

           It has been came to the notice of this union, that pressure is being exerted to open bulk Savings Bank accounts like RD, TD etc., in the single name splitting one  higher denomination as multiple lower denomination accounts. Accordingly our officials are much hardly opening bulk accounts. The instructions were categarically issued by the Directorate vide  letter No.116-26/2015-SB dated 19.06.2015 that splitting of the higher denomination is irregular and should not be put in practice. Further the SPMs could not open the huge number of accounts in Finacle. Kindly instruct the Lower level officers not to give speaking orders to split the accounts, and  to follow the instructions contained in the Directorate letter dated 19.06.2015 and also kindly intimate the procedure to be followed to turn out opening of hundred`s of accounts by single official in the stipulated time daily.

Meeting on Allowances held with Unions/Associations on 19/10/2016 : brief note thereon



A meeting on allowances was held on 19.10.2016 at G.P. Roy Committee Room, Dak Bhawan, New Delhi under the Chairmanship of Shri B.V. Sudhakar, Secretary (Posts). Shri A.K. D
ash, Member (P), Shri S.K. Dashora, DDG (Estt) and Director (Estt) were present.

Shri Vilas Ingale General Secretay, Shri P. Ajit Kumar, Asst. General Secretary-I and Shri Arup Seal, Circle Secretary West Bengal Circle attended the meeting. 

Discussion on following allowances to be retained in Department of Posts was held. All the union leaders took active part in the discussion and requested Chairman to recommend retention of following allowances strongly to MoF. The views of Secretary (Posts) were positive on the allowances discussed in the meeting. We hope positive outcome.

1)  Fixed Medical Compensation being given to Postman: 

It is proposed that suitable increase in the FMC say Rs. 200/- per day for additional beat and Rs. 100/- per day for divided beats and further increase in it by 25% very time when 50% increase in DA. 

2)  Special allowance to PO and RMS Accountants : 

It is proposed that the allowance is required to be continue with justified increase in the allowance. The allowance be re-notified as per provision laid down in para No. 8.2.5 of the 7CPC report.

3)  Cycle Allowance : 

It is proposed to retain with doubled the amount. 

4)  Cash handling and Treasury Allowance: 

It is proposed that cash handling allowance for its staff not only to be retained and also required to be increased proportionately. 

5)  Overtime Allowance : 

Long discussion held on this issue. Department recommends not only to retain the OTA in Department of Posts but also to increase the OTA to Rs. 100/- per hour and further increase by 25% every time the DA increase by 50%.

6)  Saving Bank Allowance in Post Offices : 

Department proposes that the Saving Bank Allowance be retained at doubled rate of the present allowance.

7)  Family Planning Allowances : 

Department proposes that the Family Planning Allowance should not be withdrawn from one already granted.

8)  Fixed Medical Allowance : 

In the interregnum period, the FMA may be allowed at rate of Rs. 2000/- per month. 

9)  Headquarter Allowance : 

Department proposes to retain the Headquarters Allowance at the uniform rate of 10% of the basic pay subject to ceiling of Rs. 4000/- per month to all eligible JAG/STS/JTS/AD/AAOs/Sr.AO/ASPs/IPs officers in Department of Posts. 

10)              Other Allowances : 

a)  Split Duty Allowance : 

For performance of split duty having break of less than 2 hours and residence being beyond 5 KM from duty place. 

b)  Outstation Duty Allowance : 

For performance of outstation duties while performing duties on sections

c)   Night Halt Allowance : 

In lieu of TA for night halt away from HQ while on their beats in the course of their duty. 

d)  Special Allowance : ( Special Allowance is admissible to DPS posted at Unit HQ at Mumbai, Kolkata, Chennai / JTS officers when posted at HQ / APMG (C), APMG (Planning), APMG (Vig.) in Circle Office/ PS Gr. B officers posted as Administrative Officers at PTCs, Assistant Directors in COS/ROs / PS Gr. B officer posted as Supdt. Seals Aligarh / PS Gr. B officers posted as Lectureres, ASPs in PTCs / LSG Officials employed as instructors in PTCs / Technician in PTCs. / SAs when posted in CO as Stg. Complier / IPs when posted as Platform Inspector / Project Operator Sound / Franking Machine Operator / Photocopier Operator (MTS) / Generator Operator / Clerical and allied cadres working as JA/SA, Pas on passing JAO Part-II Exam but awaiting promotion. 



Department proposes to retain allowances to above posts as arduous nature of duties.
