OFFICE MEMORANDUM

Subject: Availability of option for fixation of pay on promotion from the Date of Next Increment (DNI) in the lower post and method of fixation of pay from DNI, if opted for, in context of CCS (RP) Rules, 2016-regarding.

Prior to implementation of 6th CPC Report, the pay fixation on promotion was governed by provisions of FR 22(I)(a)(1). In 6th CPC context, the first part of FR 22(I)(a)(1) was replaced by Rule 13 of CCS (RP) Rules, 2008. Similarly, consequent upon implementation of CCS (RP) Rules, 2016 in 7th CPC context, the pay fixation on promotion is regulated by the provisions of Rule 13 of CCS (RP) Rules, 2016. This rule regulates pay fixation on promotion if the same is opted by the employee from the date of promotion itself. The issue of relevancy of provisions of FR 22(I)(a)(1) as well as the methodology of fixation of pay on promotion to a post carrying duties and responsibilities of greater importance, of a Government Servant in case he opts for pay fixation from the Date of Next Increment (DNI) has been considered in this Department.

2. In this context, proviso under FR 22(I)(a)(1) inter-alia provides that the Government Servant (other than those appointed on deputation basis to ex-cadre post or on ad-hoc basis or on direct recruitment basis) shall have the option, to be exercised within one month from the date of promotion, to have the pay fixed under this rule from the date of such promotion or to have the pay fixed from the date of accrual of next increment in the scale of the pay in lower grade.

3. After due consideration in this matter, the President is pleased to decide as follows:

(i) FR 22(I)(a)(1) holds good with regard to availability of option clause for pay fixation, to a Government Servant holding a post, other than a tenure post, in a substantive or temporary or officiating capacity, who is promoted or appointed in a substantive, temporary or officiating capacity, as the case may be, subject to the fulfillment of the eligibility conditions as prescribed in the relevant Recruitment Rules,to another post carrying duties or responsibilities of greater importance than those attaching to the post held by him/her. Such Government Servant may opt to have his/her pay fixed from the Date of his/her Next Increment (either 1st July or 1st January, as the case may be) accruing in the Level of the post from which he/she is promoted, except in cases of appointment on deputation basis to an ex-cadre post or on direct recruitment basis or appointment/promotion on ad-hoc basis.

(ii) In case, consequent upon his/her promotion, the Government Servant opts to his/her pay fixed from the date of his/her next increment (either 1″ July or 1″January, as the case may be) in the Level of the post from which Government Servant is promoted, then, from the date of promotion till his/her DNI, the Government Servant shall be placed at the next higher cell in the level of the post to which he/she is promoted.

(iii) Subsequently, on DNI in the level of the post to which Government Servant is promoted, his//her Pay will be re-fixed and two increments (one accrued on account of annual increment and the second accrued on account of promotion) may be granted in the Level from which the Government Servant is promoted and he/she shall be placed, at a Cell equal to the figure so arrived, in the Level of the post to which he/she is promoted; and if no such Cell is available in the Level to which he/she is promoted, he/she shall be placed at the next higher Cell in that Level.(iv) In such cases where Government Servant opts to have his/her pay fixed from the date of his/her next increment in the Level of the post from which he/she is promoted, the next increment as well as Date of Next Increment (DNI) will be regulated accordingly.

4. It is further reiterated that in order to enable the officials to exercise the option within the time limit prescribed, the option clause for pay fixation on promotion with effect from date of promotion/DNI shall invariably be incorporated in the promotion/appointment order so that there are no cases of delay in exercising the options due to administrative lapse.

5. In so far as their application to the employees belonging to the Indian Audit and Accounts Department is concerned, these orders issue in consultation with the Comptroller &Auditor General of India.

27-07-2017 - 'MARCH TO SANCHAR BHAWAN' BY AIPEU-GDS - A GRAND SUCCESS

AIPEU-GDS conducted the agitation programme “March to Sanchar Bhawan” in Delhi today (27-07-2017) with the full support of NFPE. The progamme was inaugurated by Com.A.K.Padmanabhan, Vice President, CITU with an inspiring speech explaining the attacks of the policies of the BJP Govt on working class and employees sections of this country.  A procession was conducted with hundreds of GDS comrades  holding flags & banners with slogans from Jantar Mantar to Sanchar Bhawan. But, because of Parliament sessions going on, the police not permitted the rally ahead to Sanchar Bhawan. The procession lead by Com.M.Krishnan, Secretary General, Confederation, Com,R.N.Parashar, Secretary General, NFPE & General Secretary, Gr.C., Com.Giriraj Singh, President NFPE & General Secretary, R-III., Com.Vikram Shah, General Secretary, P4., Com.V.Tiwary, General Secretary, SBCO., Com.S.B.Yadav, General Secretary, AIPAEA., Com. Com.P.Mohan, General Secretary, Causal & Contingent Union, Com.Manoharan, Wkg. President, NFPE, Com.BoJoy Gopal Sur, President, Com.P.Pandurangarao, G/S, AIPEU-GDS and many other leader of NFPE & other organizations.

          A meeting has been conducted with large gathering in the Jantar Mantar itself under the presidentship of Com.Bijoy Gopal Sur, All India President, AIPEU-GDS. Com.P.Pandurangarao, General Secretary welcomed the distinguished leaders, CHQ Office bearers, Circle Secretaries, GDS comrades represented from 16 circles.
Com.R.N.Parashar, Secretary General, NFPE made an elaborate speech on the current issues of GDS and assured that NFPE shall  take care of GDS at all levels. Com.M.Krishnan,Secretary General, Confederation explained the issues of GDS and appeal all to make the AIPEU-GDS as No.1 recognized Union. Com.V.A.N.Namboodiri, former General Secretary, BSNLEU, Com.Santhosh Kumar, President, AIPAEA., Com.Balwinder singh, Fin. Secretary, Gr.C (CHQ), Com.Y.Nagabhushanam & Com.D.Sivagurunathan, Casual & Contingent Union also addressed in the meeting. In addition, all the General Secretaries of NFPE affiliated unions mentioned above also addressed the rally.
          The AIPEU-GDS CHQ leaders viz., Com.Virendra Sharma, Wkg President, Com.Nirmal Singh, Vice President, Com.Jai Prakash singh, AGS., Com.Kumaran Nambiyar, Fin Secretary, Com.Harish Kumar, Asst Fin. Secretary, Com.Chandra N.Chaudary, Orgg Gen Secretary & Com.Ambika Sharma also addressed in the meeting.
          The programme concluded with the vote thanks offered by Com.Pamodkumar singh, Circle Secretary, Uttar Pradesh with the assurance of obtaining 90% membership in favour of AIPEU-GDS from UP Circle.
          Meeting ended with the slogan shouting by Com.Virendra Sharma demanding the Govt & Department for the earliest implementation of Shri Kamalesh Chandra Committee.
          After the procession, a memorandum was submitted to Hon’ble Minister of Communications by the Office bearers, which is published below.

GDS COMMITTEE REPORT - INFORMATION - AN UPDATE


           Today on 21.07.2017, Com. R.N. Parashar Secretary General, NFPE met the higher officers of the Department of Posts and made enquiry about the progress on GDS Committee report.

            It has been told by the higher officers  of the Department of Posts  that GDS Committee Report has been sent to Ministry of Finance  for approval, after approval from  Hon`ble Minister Communications.

            We have requested the concerned officers to approach the officers of Finance Ministry and get it approved as early as possible.

            We hope that it will be implemented very soon.
           
            We appeal to all GDS to become member of AIPEU-GDS and make it as No.1 Union.

            We request all Circle / Divisional and Branch Secretaries of all NFPE Unions particularly of P-III & P-IV to extend full help, co-operation and support to AIPEU-GDS for enrollment of maximum membership and make it as No.1 Union.

Dear Comrades,

The implementation of the Recommendations of Kamalesh Chandra Committee is one of  the most important tasks for our GDS. Our union demanding the Govt & Department to implement all the positive recommendations of the GDS Committee at the earliest.

From 24th Nov'2016 to 18/19th January 2017 (2 months) we could not able to see the Report.

From that date up to 17th March 2017 (2 months) because of Election code it was kept idle and no progress.

Again from that date,  till today (4 months) the file is moving in such a way to drag the situation. Govt & department repeatedly prompting that the 'matter is under active consideration' in a routine way.

The emphasis made by all on the implementation of the GDS committee at the earliest is that the issue of retiring GDS and regular GDS as well. The GDS retiring from the service during this period of time are foregoing their retirement benefits because of the date of implementation of the recommendations of the Committee.

After taking into consideration of all the issues in Central Working Committee held on 5th May 2017 taken a decision to implement a phased programme of action including strike.

MARCH TO SANCHAR BHAWAN (O/o the Minister of Communications & IT), NEW DELHI  is the second phase of programme by AIPEU-GDS.

With the demand of GDS along with other demands, NFPE declared one day strike on 23rd August 2017 and tour/campaign programme is going on in the Circles by NFPE leadership.

All the CHQ Office bearers, Circle Secretaries, Division / Branch Secretaries, Active Comrades, well-wishers of our Union are once again requested to mobilize the GDS comrades in hundreds from all Circles to roar with thousands in front of Sanchar Bhawan on 27th July 2017 to show our resentment and anger over the delay in the implementation of the recommendations of Kamalesh Chandra Committee.

ANNEXURE
Annexure to Ministry of Finance, Department of Expenditure
O.M.No.19030/112017-E.IV dated 10th July 2017.

In supersession of Department of Expenditure’s O.M. No. 19030/3/2008-E.IV dated 23.09.2008, in respect of Travelling Allowance the following provisions will be applicable with effect from 01.07.2017 :

2.Entitlements for Journeys on Tour or Training


A.(i) Travel Entitlements within the Country

(ii) It has also been decided to allow the Government officials to travel by Premium Trains/Premium Tatkal Trains/Suvidha Trains, the reimbursement to Premium Tatkal Charges for booking of tickets and the reimbursement of Dynamic/Flexi-fare in Shatabdi/Rajdhani/Duronto Trains while on official tour/ training. Reimbursement of Tatkal Seva Charges which has fixed fare, will remain continue to be allowed. Travel entitlement for the journey in Premium/Premium Tatkal/Suvidha/ Shatabdi/Rajdhani/ Duronto Trains will be as under :-

(iii) The revised Travel entitlements are subject to following:-

a.In case of places not connected by rail, travel by AC bus for all those entitled to travel by AC II Tier and above by train and by Deluxe/ordinary bus for others is allowed.

b.In case of road travel between places connected by rail, travel by any means of public transport is allowed provided the total fare does not exceed the train fare by the entitled class.

c.All mileage points earned by Government employees on tickets purchased for official travel shall be utilized by the concerned department for other official travel by their officers. Any usage of these mileage points for purposes of private travel by an officer will attract departmental action. This is to ensure that the benefits out of official travel, which is funded by the Government, should accrue to the Government .

d.In case of non-availability of seats in entitled class, Govt. servants may travel in the class below their entitled class.


B. International Travel Entitlement :

ii.Reimbursement of Hotel charges :- For levels 8 and below, the amount of claim (up to the ceiling) may be paid without production of vouchers against self-certified claim only. The self-certified claim should clearly indicate the period of stay, name of dwelling, etc. Additionally, for stay in Class ‘X’ cities, the ceiling for all employees up to Level 8 would be X1,000 per day, but it will only be in the form of reimbursement upon production of relevant vouchers. The ceiling for reimbursement of hotel charges will further rise by 25 percent whenever DA increases by 50 persent

iii. Reimbursement of Travelling charges :- Similar to Reimbursement of staying accommodation charges, for levels 8 and below, the claim (up to the ceiling) may be paid without production of vouchers against self- certified claim only. The self-certified claim should clearly indicate the period of travel, vehicle number, etc. The ceiling for levels 11 and below will further rise by 25 percent whenever DA increases by 50 percent. For journeys on foot, an allowance of Rs.12/- per kilometer travelled on foot shall be payable additionally. This rate will further increase by 25% whenever DA increases by 50%.

iv.Reimbursement of Food charges :- There will be no separate reimbursement of food bills. Instead, the lump sum amount payable will be as per Table E(i) above and, depending on the length of absence from headquarters, would be regulated as per Table (v) below. Since the concept of reimbursement has been done away with, no vouchers will be required. This methodology is in line with that followed by Indian Railways at present (with suitable enhancement of rates). i.e. Lump sum amount payable. The lump sum amount will increase by 25 percent whenever DA increase by 50 percent.



V. Timing restrictions

Absence from Head Quarter will be reckoned from midnight to midnight and will be calculated on a per day basis.

(vi) In case of stay/journey on Government ships, boats etc. or journey to remote places on foot/mules etc for scientific/data collection purposes in organization like FSI, Survey of India, GSI etc., daily allowance will be paid at rate equivalent to that provided for reimbursement of food bill. However, in this case, the amount will be sanctioned irrespective of the actual expenditure incurred on this account with the approval of the Head of Department/controlling officer.

Note : DA rates for foreign travel will be regulated as prescribed by Ministry of External Affairs.



3.T.A. on Transfer

TA on Transfer includes 4 components : (i) Travel entitlement for self and family (ii) Composite Transfer and packing grant (CTG) (iii) Reimbursement of charges on transportation of personal effects (iv) Reimbursement of charges on transportation of conveyance.

(i) Travel Entitlements :
a. Travel entitlements as prescribed for tour in Para 2 above, except for International Travel, will be applicable in case of journeys on transfer. The general conditions of admissibility prescribed in S.R.114 will, however, continue to be applicable.

b. The provisions relating to small family norms as contained in para 4(A) of Annexure to M/o Finance O.M. F.No. 10/2/98-IC & F.No. 19030/2/97-EIV dt. 171, April 1998 , shall continue to be applicable.



(ii)Composite Transfer and Packing Grant (CTG) :


a.The Composite Transfer Grant shall be paid at the rate of 80% of the last month’s basic pay in case of transfer involving a change of station located at a distance of or more than 20 kms from each other. However, for transfer to and from the Island territories of Andaman, Nicobar & Lakshadweep, CTG shall be paid at the rate of 100% of last month’s basic pay. Further, NPA and MSP shall not be included as part of basic pay while determining entitlement for CTG.

b.In cases of transfer to stations which are at a distance of less than 20 kms from the old station and of transfer within athe same city, one third of the composite transfer grant will be admissible, provided a change of residence is actually involved.

c.In cases where the transfer of husband and wife takes place within six months, but after 60 days of the transfer of the spouse, fifty percent of the transfer grant on transfer shall be allowed to the spouse transferred later. No transfer grant shall be admissible to the spouse transferred later, in case both the transfers are ordered within 60 days. The existing provisions shall continue to be applicable in case of transfers after a period of six months or more. Other rules precluding transfer grant in case of transfer at own request or transfer other than in public interest, shall continue to apply unchanged in their case.

(iii) Transportation of Personal Effects

The rates will further rise by 25 percent whenever DA increases by 50 percent. The rates for transporting the entitled weight by Steamer will be equal to the prevailing rates prescribed by such transport in ships operated by Shipping Corporation of India. The claim for reimbursement shall be admissible subject to the production of actual receipts/ vouchers by the Govt. servant. Production of receipts/vouchers is mandatory in r/o transfer cases of North Eastern Region, Andaman & Nicobar Islands and Lakshadweep also.

Transportation of personal effects by road is as per kilometer basis only. The classification of cities /towns for the purpose of transportation of personal effects is done away with.





(iv) Transportation of Conveyance.

4. T.A. Entitlement of Retiring Employees


TA on Retirement includes 4 components : –

(i) Travel entitlement for self and family (ii) Composite Transfer and packing grant (CTG) (iii) Reimbursement of charges on transportation of personal effects (iv) Reimbursement of charges on transportation of conveyance.



(i) Travel Entitlements

Travel entitlements as prescribed for tour/transfer in Para 2 above, except for International Travel, will be applicable in case of journeys on retirement. The general conditions of admissibility prescribed in S.R.147 will, however, continue to be applicable.



(ii)Composite Transfer Grant(CTG)


a.The Composite Transfer Grant shall be paid at the rate of 80% of the last month’s basic pay in case of those employees, who on retirement , settled down at places other than last station(s) of their duty located at a distance of or more than 20 km. However, in case of settlement to and from the Island territories of Andaman, Nicobar & Lakshadweep, CTG shall be paid at the rate of 100% of last month’s basic pay. Further, NPA and MSP shall not be included as part of basic pay while determining entitlement for CTG. The transfer incidentals and road mileage for journeys between the residence and the railway station/bus stand, etc., at the old and new station, are already subsumed in the composite transfer grant and will not be separately admissible.

b.As in the case of serving employees, Government servants who, on retirement, settle at the last station of duty itself or within a distance of less than 20 kms may be paid one third of the CTG subject to the condition that a change of residence is actually involved.

(iii) Transportation of Personal Effects :- Same as Para 3(iii) above.

(iv) Transportation of Conveyance :- Same as Para 3(iv) above.
The general conditions of admissibility of TA on Retirement as prescribed in S.R. 147 will, however, continue to be applicable.
